Thousands of Australian workers across some of the most hazardous industries could lose important occupational health and safety protections if recommendations just released are adopted by all governments. The USU is urging members to send a message to NSW Members of Parliament about this vital issue. The USU has serious concerns about a review panel report on the
harmonization of Australia’s Occupational Health and Safety laws which
was commissioned last year by the Council of Australian Governments
(COAG) as part of its move to establish uniform laws and regulations
across all jurisdictions.

"This meeting of delegates, members and OHS Representatives calls on the NSW State Government to reject a number of the National OHS Review Panel recommendations on the basis that health and safety standards will be reduced.
Further that the NSW Government support and protect the high Occupational Health and Safety legislative standards that currently exist in NSW. In particular:
The absolute duty of care of employers to provide a safe workplace
Onus of Proof on the Employer
Proper and effective right of entry provisions
A right for Unions to Prosecute
A requirement that consultation must occur in regards to OHS matters in a workplace
Provisions ensuring that HSRs are able to effectively carry out their functions
This meeting endorses Unions NSW seeking an urgent meeting with the Premier and the Minister in order to protect the high legislative standards in NSW, as a minimum.
Further we commit to an ongoing campaign including education of members at workplaces, lobbying of State and Federal MPs and highlighting through the media the importance of OHS in our workplaces.
Finally we call on the Rudd Government to ensure that the terms of reference, in particular “that health and safety standards will not be reduced” is adhered to as part of the National OHS Harmonisation process."
