The USU has commenced a Protect 08 Campaign for councils to sign a council agreement guaranteeing all employees rightful access to a general wage increase in 2008. Commitments made by both the New South Wales and Federal Governments to pass new industrial laws replacing WorkChoices have been slow to come to fruition. Negotiations between the State and Commonwealth are bogged down in intergovernmental wrangling. With a general increase due to take effect from 1 November 2008 councils need to sign a Protect 08 Council Agreement shielding both councils and employees from legal and financial uncertainty. FEDERAL COURT RULES: Councils Not Constitutional Corporations
Sep 5, 2008: On 20 August 2008 Justice Spender of the Federal Court of Australia ruled that Etheridge Shire Council in Queensland was NOT A CONSTITUTIONAL CORPORATION and COULD NOT be covered by a federal WorkChoices agreement.

Great news for Australian council workers and for employees under our State Award
Aug 20, 2008: The Etheridge decision has come down with a single Justice of the Federal Court finding that this council, under the relevant circumstances, was NOT A CONSTITUTIONAL TRADING CORPORATION and COULD NOT be covered by a federal WorkChoices agreement.

Aug 20, 2008: Pay and conditions for local government workers are one step closer being protected under the State Award following a landmark decision from the Federal Court today.

AFPC 2008 Wage Setting Decision: Constitutional Corporation Update
Jul 29, 2008: Jurisdictional uncertainty regarding the question whether New South Wales local government is in the state or federal industrial relations systems remains. The USU continues to campaign for the Premier to decorporatise local government in New South Wales and to write to the Prime Minister asking him to stand by his pre election commitment to the USU and exclude local government from the federal industrial relations system. In the interim action is required to secure the 3.2% increase in wages and allowances due on 1 November 2008.
